This English text is a translation provided for convenience only. The Dutch version of these terms is legally binding; in the event of any discrepancy, the Dutch text prevails. These terms and the agreement are governed by Dutch law.
Article 1 — Definitions
- CarwashManager / we: Carwash Manager, Chamber of Commerce 73612537, provider of the software.
- Customer: the business (car wash, wash tunnel or comparable company) that enters into an agreement with us.
- Service: the online software of CarwashManager, available via carwashmanager.app and its associated subdomains.
Article 2 — Applicability
These terms apply to every offer and every agreement between CarwashManager and the Customer. Deviations apply only if we confirm them in writing. Our service is intended exclusively for business use.
Article 3 — Offer and agreement
The agreement is concluded when the Customer registers via carwashmanager.app and makes the first payment. The Customer warrants the accuracy of the details provided.
Article 4 — Prices and payment
- The service costs €97 per month (excl. VAT). There are no set-up fees.
- On registration the Customer pays the first month in advance; that payment also authorises us to collect the monthly instalments by direct debit.
- Payments are processed via our payment service provider Mollie. Subsequent instalments are collected automatically each month.
- If a direct debit fails, access to the service may be suspended until payment has been made.
- We may adjust the price; we announce any change at least one month in advance. If you do not agree, you may cancel with effect from the effective date.
Article 5 — Term and cancellation
The agreement can be cancelled monthly. On cancellation the service continues until the end of the period already paid for; instalments already paid are not refunded.
Article 6 — Right of use
For the duration of the agreement the Customer receives a non-exclusive, non-transferable right to use the service for its own business. It is not permitted to resell the service or make it available to third parties without our permission.
Article 7 — Customer obligations
- The Customer uses the service lawfully and not for fraudulent or unlawful purposes.
- The Customer is responsible for its own account and login details and for the data it enters into the service.
- The Customer arranges its own integrations (such as its own Mollie account for sales to its customers) and ensures correct business and invoicing details.
Article 8 — Availability and maintenance
We make every effort to keep the service available as well as possible, but give no guarantee of uninterrupted availability. The service may be temporarily unavailable for maintenance or updates; we try to keep this to a minimum.
The service is provided "as is": we do not guarantee that the service works flawlessly or is suitable for a specific purpose of the Customer. New or optional components and updates may be offered as beta or "as is".
Article 9 — Liability
Our liability is limited to direct damage and to no more than the amount the Customer paid in the three months before the event causing the damage. We are not liable for indirect damage, such as lost turnover or profit, or for damage caused by improper use or by third-party services (such as payment or email services).
Article 10 — Intellectual property
All rights to the software and the service remain with CarwashManager. The data the Customer enters remains the property of the Customer; on termination the Customer can (have) its data exported within a reasonable period.
Article 11 — Personal data
When processing personal data we act as processor for the data of the Customer's end customers; a data processing agreement applies to this. See further our privacy policy.
Article 12 — Licence-plate marketing (optional module)
Licence-plate marketing is an optional module in which a camera recognises licence plates. The following applies in addition:
- No guarantee of recognition. The technology may miss licence plates or read them incorrectly, for example due to lighting, weather conditions, camera position, speed or dirt. Results are indicative and do not form a basis for claims; the Customer bases no irreversible decisions on them.
- The Customer provides sufficient lighting.Plate recognition works with what the camera can see. In daylight or at a well-lit entrance virtually every plate is read; with insufficient light a plate is poorly readable or not readable at all. The Customer ensures that the entrance is sufficiently lit during its opening hours — including in the darker months and in the evening — such that a plate is clearly legible to the naked eye at the camera's position. If the Customer fails to do so, any resulting drop in recognition is for its own account and does not give rise to any right to a refund, discount, suspension or termination. If the Customer is unsure whether its entrance qualifies, we discuss this before purchase.
- No plate, no recognition. Vehicles without a readable front plate — such as microcars, quads and trailers — cannot be recognised. Foreign plates are read, but make and model details are not available for them (those come from the Dutch vehicle register).
- The Customer is the controller for the use of the camera at its location. The Customer itself ensures a valid legal basis and informs visitors (for example via a camera surveillance sticker at the entrance and its own privacy statement). We act solely as processor; see the data processing agreement.
- Equipment and placement. We supply the camera ready to use and handle the configuration and the connection with the platform (remotely). The Customer places the camera on location itself, following the supplied step-by-step guide. We are not liable for the physical placement, the operation, the availability or the accuracy of the equipment, nor for any damage arising from it.
Article 13 — Amendment of the terms
We may amend these terms. We announce material changes in advance. The most current version is always on this page.
Article 14 — Applicable law
These terms and the agreement are governed by Dutch law. We submit disputes to the competent court in the Netherlands.
